/ Common Questions

Straight answers to the questions that matter

Most people arrive here with a specific doubt—about cost, enforceability, or what happens when the other side won't show up. These answers are direct because your situation doesn't have time for hedging.

— Confidentiality & Enforceability

Is what I say in mediation confidential?

Yes. Mediation sessions are confidential by statute in most jurisdictions, and ConflictBridge sessions begin under a signed confidentiality agreement. Nothing disclosed can be used in subsequent litigation.

Are arbitration decisions actually binding?

Arbitration awards are legally binding and court-enforceable under the Federal Arbitration Act and applicable state statutes. An arbitration decision carries the same enforceability as a court judgment—without the trial timeline.

How does cost compare to litigation?

Most disputes resolved through mediation or arbitration conclude in weeks, not years, at a fraction of litigation costs. Fees are disclosed at intake; there are no surprise billings mid-process.

— Participation & Resistance

What if the other party refuses to participate?

Refusal is common at the outset. ConflictBridge uses structured pre-mediation outreach—direct contact, attorney-to-attorney framing, or a neutral invitation letter—to open the door without forcing it.

Can mediation work when one side is adversarial?

Adversarial posturing is normal. The process is designed for it. Caucus sessions keep parties separate when joint sessions aren't productive, and the mediator manages communication between them directly.

— Intake & Suitability

Does ConflictBridge take every case?

No. Every engagement begins with a suitability assessment. If the dispute isn't suited to mediation or arbitration—due to power imbalance, safety concerns, or jurisdictional constraints—we say so clearly at intake.

How quickly can a process begin?

Initial intake typically occurs within one to three business days of first contact. A full session schedule is set after both parties confirm participation. Most processes begin within two weeks of intake.

A brief intake conversation costs nothing and tells both of us whether this process is the right fit. Confidentiality begins at first contact.
